El daño punitivo es igualmente conocido como daño ejemplarizante, daño retributivo o dinero picante. 4 Se ha entendido como una forma de pena privada, donde el beneficiario de esas sumas de dinero es la víctima del daño causado, lo cual hace de este un sistema tan particular y criticado.
