Tbs staat voor terbeschikkingstelling. Het is primair een beveiligingsmaatregel die de rechter kan opleggen om de samenleving te beschermen als iemand een misdrijf heeft gepleegd terwijl hij leed aan een ‘gebrekkige ontwikkeling of ziekelijke stoornis van zijn geestvermogens’ en er vrees is voor herhaling. Er kan bijvoorbeeld sprake zijn van een persoonlijkheidsstoornis of psychose.
