On September 20, 2010 it was announced that former bassist, Chris Rybicki was killed in a car accident caused by an intoxicated woman. He was 39 years old. On October 25, 2010, Unearth issued a statement saying they and Derek Kerswill had amicably parted ways.

About Unearth. Unearth is a Metalcore band formed in Boston, Massachusetts in 1998 by singer Trevor Phipps, guitarists Buz McGrath and Ken Susi, bassist Chris Rybicki and drummer Mike Rudberg.

The cause was injuries sustained from a traffic accident three weeks ago, in which Rybicki, who was all of 39 years old, was riding a scooter when an allegedly drunk driver, 25 year-old Beth MacGillivary, hit him with her car.
